$7,625,000.00 – Asbestos Exposure- Wrongful Death
Plaintiff, an Engineer, developed mesothelioma cancer as a result of being exposed
to asbestos fibers. The exposure took place in the early 1970’s but the
cancer did not manifest itself for thirty (30) years. Plaintiff died as a result,
and an action was commenced by plaintiff’s wife for wrongful death, pain
and suffering and lost earnings. HKPD served a co-counsel. The case settled
before trial for $7,625,000.00.
$3,300,000.00 – Iron Worker – Labor Law – Multiple Fractures
Plaintiff, a Union Iron Worker, was injured when he fell approximately 25 feet from an unprotected stairwell while working on the construction of the New York Post newspaper processing plant. Plaintiff sustained a fractured femur requiring the placement of an intramedullary rod and fractured ankle requiring pins and screws. Plaintiff commenced an action against the property owner and general contractor pursuant to Labor Law § 241(6) and § 200. The Supreme Court granted defendant’s motion for summary judgment and HKPD was successful in having the decision reversed on appeal. The defendant claimed that the accident occurred because the plaintiff was intoxicated. HKPD was able to convince the jury that any intoxication was not the cause of the accident. The case settled during trial for $3,300,000.00
$2,500,000.00 – Injured Sanitation Worker – Motor
Vehicle -Fractured Hip
Plaintiff, a New York City Department of Sanitation Worker,
was struck by a sanitation truck while on the job. Plaintiff sustained
a fractured hip requiring an open reduction surgery with the placement
of metal hardware Plaintiff ultimately underwent a total hip replacement
and was unable to return to work. Plaintiff sued the City of New York for
negligence, pain and suffering and lost wages. Case settled $2,500,000.00
while the jury was deliberating.
$1,500,000.00 – Injured Beautician – Motor Vehicle/Municipal Liability – Multiple Injuries
Plaintiff, a proprietor of a beauty salon, was injured when a car in which she was a passenger, struck a large pot hole on Jamaica Avenue in Queens, New York. As a result of striking the hole, plaintiff was thrown violently into the roof of the car. Plaintiff was taken to the emergency room complaining of shoulder pain and back pain. Plaintiff ultimately underwent several shoulder surgeries and lower back surgeries. HKPD was able to obtain documents that proved the City of New York was aware of the pothole yet took no action to repair same. The case was tried to verdict and the City was found partially at fault for causing the accident and thereafter settled for $400,000.00 Plaintiff proceeded to trial on the issue of damages and was awarded 1,500,000.00 by the court.
$1,250,000.00 – Injured New York City Fireman – Premises
Liability - Neck Surgery
Plaintiff, a Lieutenant in the New York City Fire Department,
was injured while responding to a call when his mask got caught on a metal
protrusion. Plaintiff sustained a neck injury that ultimately required
a cervical discectomy and spinal fusion at C5-6 and C6-7. Plaintiff sued
the building owner and managing agent for negligence, violations of the
New York City Building Code, pain and suffering and lost wages. The case
settled for $1,250,000.00 before trial.
$1,180,000.00 – Injured Building Maintenance Worker – Premises
Liability – Burns
Plaintiff, a maintenance worker, was badly burned while refinishing
a wooden floor with polyurethane. Plaintiff was operating a sander when
a spark ignited the pilot light of a stove causing an explosion. Plaintiff
sued the manufacturer of the polyurethane for product liability and defective
warnings; and the building owner for negligence. Case settled for $1,180,000.00
while the jury was deliberating.
$1,050,000.00 – Injured Child – Premises Liability
- Lead Poisoning
Plaintiff was exposed to hazardous lead paint, dust and chips
while residing at a premises owned by the City of New York. Plaintiff had
an elevated blood level of 47, requiring hospitalization and chelation
therapy. Plaintiff sued the City of New York for negligence, pain and suffering
and lost earning capacity. Case settled before jury selection for $1,050,000.00

Plaintiff, a construction worker, was injured when he was struck
by a falling object while on the job. Plaintiff sustained a closed head
injury and multiple fractures. Case settled before jury selection for $950,000.00
$925,000.00 – Injured Man – Wrongful death - Burns
Plaintiff suffered severe burns and died as a result of the
negligence of the defendant. Plaintiff died almost immediately. Plaintiff
commenced an action for Wrongful Death. The case settled during a Trial
Conference for $925,000.00.
$900,000.00 – Injured Construction Worker –Labor
Law – Back Surgery
Plaintiff, a construction worker, was injured when a scaffold
collapsed, causing him to fall through an unguarded opening. Plaintiff
sustained multiple rib fractures as well as herniated discs in his lower
back requiring a lumbar fusion surgery. Plaintiff sued the owner and general
contractor, and was granted summary judgment by the Court on the issue
of liability pursuant to Labor Law § 240. The case settled before
jury selection for $900,000.00.
$875,000.00 – Injured Passenger – Motor Vehicle – Fractured Shoulder
Plaintiff, a passenger, was involved in a two-car motor vehicle
accident. Plaintiff suffered a fractured humerus requiring an open reduction
with the placement of metal hardware and a nerve injury. Plaintiff was
not wearing her seatbelt at the time of the accident. Plaintiff commenced
an action against the driver and owner of each vehicle for negligence
and pain and suffering. The case settled before jury selection
for $875,000.00.
$850,000.00 – Injured Deliveryman – Slip and Fall – Back
Surgery
Plaintiff, a beverage deliveryman, was injured when he slipped
and fell on a greasy substance leaking from a dumpster. Plaintiff sustained
an injury to his lower back requiring a lumbar spinal fusion; and an elbow
injury requiring surgery. Plaintiff commenced an action against the building
owner for negligence and pain and suffering. The case settled at a mediation for
$850,000.00.

Plaintiff, a union HVAC installer, was injured when he tripped
and fell on a loose pipe that had been left in the grass. Plaintiff sustained
a herniated disc in his lower back requiring a lumbar fusion surgery. Plaintiff
sued the owner and general contractor pursuant to the Labor Law. The case
settled while a motion to dismiss was pending for $850,000.00

Surgery
Plaintiff, a boiler mechanic, was injured when an elevator
in which he was riding plummeted and came to a sudden and violent stop.
Plaintiff fell to the floor and injured his back requiring surgery. Plaintiff
sued the elevator company and building owner for negligence in failing
to properly maintain the elevator. The case settled before jury selection
for $850,000.00
$800,000.00 – Shooting Victims –Negligent Security– Gun
Shot wounds
HKPD represented plaintiffs who sustained serious injuries
including gun shot wounds requiring surgery and various fractures. Plaintiffs
were attending a party at Chelsea Piers when they were caught in the cross-fire
of gun play. Plaintiffs sued the property owner for negligent security.
HKPD defeated a motion for summary judgment and won the ensuing appeal
in the Appellate Division, First Department. The case settled before jury
selection for $800,000.00.
$775,000.00 - Construction Worker –Labor Law – Fractured
Wrist
Plaintiff, a construction worker, was injured when he fell
from an unsecured A-Frame ladder. Plaintiff sustained a fractured wrist
requiring two (2) surgeries. Plaintiff commenced an action against the
building owner pursuant to Labor Law § 240. Plaintiff was granted
summary judgment on the issues of liability. The case settled at mediation
for $775,000.00.
$750,000.00 – Multiple Plaintiffs – Negligent Crowd
Control – Fractures
HKPD represented two plaintiffs who were injured while attending
a free concert ticket give-a-way. The defendants failed to provide adequate
crowd control causing the plaintiffs to be pushed into the street where
they were struck by an oncoming vehicle. Each plaintiff sustained fractures
requiring surgery. Plaintiff sued the radio station that sponsored the
event for negligence. The case resolved at mediation for $750,000.00.
$750,000.00 – Financial Officer – Roadway Construction – Traumatic Amputation
Plaintiff, the CEO of a large financial services institution, was walking on West 32nd Street, when a New York Transit Bus drove over and unsecured roadway plate, that became dislodged crushing the plaintiff’s foot. Plaintiff sustained a partial amputation of the great toe. The plaintiff missed one month from work and made an excellent recovery. The defendants refused to settle and the case went to trial. The jury returned a verdict in the amount of $750,000.00.
$700,000.00 – Construction Worker – Labor Law – Loss
of Vision
Plaintiff, a plumber’s helper, was injured while assisting in jack-hammer
operations when a piece of cement struck his eye. Plaintiff sustained an
eye injury that resulted in permanently blurred vision in one eye. Plaintiff
commenced an action pursuant to the Labor Law against the building owner
for failing to provide protective eyewear. The case settled at a mediation
for $700,000.00

Amputation
Plaintiff, a construction worker, was participating in pile
driving operations when a 2-ton beam rolled onto his foot. As a result,
plaintiff sustained a partial amputation of his small toe. Plaintiff was
able to return to work. Plaintiff commenced an action against the general
contractor and property owner pursuant to the Labor Law. The case settled
for $625,000.00 while a motion to dismiss was pending.
$650,000.00 – Injured Student – Trip and Fall – Fracture
Plaintiff, a student, was walking down the stairs of a New
York City Housing Authority Project, when he was caused to trip and fall
on a defective step. Plaintiff sustained a fractured femur that required
surgery. Defendant argued that the stairs were not defective and plaintiff
recovered completely from his injuries. HKPD was able to resolve this
matter before trial for $650,000.00
$640,000.00 – Retired Caretaker – Municipal Liability – Back
Surgery
Plaintiff, a retired caretaker from the New York City Housing
Authority, was injured in an accident when the defendant drove through
an intersection where there was a missing stop sign. HKPD located records
that proved the City of New York knew about the missing stop sign for two
(2) days before the accident, and failed to have it replaced. The City
offered $25,000.00, plaintiff rejected the offer and went to trial. The
jury returned a verdict for $640,000.00 against the City of New York. The
case subsequently settled while the appeal was pending.
$625,000.00 – False Arrest – False Imprisonment – Malicious
Prosecution
Plaintiff, a kitchen worker, was arrested and imprisoned for
allegedly selling narcotics. During the criminal case it was discovered
that the police officers had lied about several key issues, and the plaintiff
was acquitted. Plaintiff commenced an action against the City of New York
in the United Stated District Court, Southern District of New York, for
civil rights violations, false arrest, false imprisonment and malicious
prosecution. The case settled before trial for $625,000.00.
$600,000.00 – Injured Homemaker – Falling Ice – Nerve
Injury
Plaintiff, a homemaker, was injured when a sheet of ice fell
from the roof of a Sam’s Club owned by Wal-Mart. Plaintiff sustained
an injury to her ulnar nerve requiring surgery. Wal-Mart refused all reasonable
settlement demands. HKPD took the case to trial and the jury returned a
verdict of $600,000.00. The case was subsequently settled.

Policy
Plaintiff, a delivery driver, was injured when his vehicle
was struck in the rear while stopped in traffic. Plaintiff sustained a
herniated disc in his lower back requiring a spinal fusion surgery. The
defendant driver had a total of $500,000.00 worth of insurance coverage.
HKPD was able to obtain the full policy limits before trial.
$500,000.00 – Injured Pedestrian –Pedestrian Knockdown – Back
Injury
Plaintiff, a self-employed sign maker, was a pedestrian struck
by a Long Island University vehicle on the campus of CW Post College. Plaintiff
sustained a herniated disc in her lumbar spine requiring disc replacement
surgery. Plaintiff commenced an action against the vehicle owner and driver
for negligence and pain and suffering. The case settled immediately prior
to jury selection for $500,000.00.
$500,000.00 – Injured Police Officer – Municipal
Liability – Loss of Vision
Plaintiff, a New York City Police Department Fire Arms Instructor,
was injured when she was struck by a stray bullet fired by a co-employee.
Plaintiff sustained significant vision loss in one eye. Plaintiff was unable
to resume her job as a police officer. Plaintiff commenced an action against
the City of New York pursuant to General Municipal Law 205-e permitting
actions by police officers against the City. The case settled for $500,000.00
during litigation.
$475,000.00 – Injured Construction Worker – Slip
and Fall – Neck Injury
Plaintiff, a construction worker who was receiving disability
from a prior accident, was injured at a home improvement store when a pallet
of doors fell on his head. Plaintiff sustained an injury to his neck requiring
surgery. The case settled at a mediation for $475,000.00.
$450,000.00 – Injured Pharmacist – Chip Fracture
Plaintiff, a pharmacist, was injured when she tripped and fell
while walking through a courtyard under construction. Plaintiff sustained
a chip fracture of the elbow. Plaintiff sued the building owner
who refused to offer a reasonable settlement. HKPD took this matter to
trial and obtained a jury verdict of $450,000.00. The case subsequently
settled while on appeal.
$450,000.00 – Injured Cleaner – Premises Liability – Clavicle
Fracture
Plaintiff, a hotel housekeeper, was injured when she tripped
and fell walking down stairs in her apartment building. Plaintiff sustained
a fractured clavicle and several fractured ribs. Plaintiff commenced an
action against the building owner for negligence, failing to provide adequate
lighting and violations of the building code. The case settled at a mediation
for $475,000.00.
$400,000.00 – Injured Hairdresser – Motor Vehicle – Torn
Meniscus
Plaintiff, a student, was a passenger on a motorcycle when
it was struck by the defendant’s vehicle. Plaintiff sustained severe
road rash as well as a torn meniscus of her right knee that required arthroscopic
surgery. Plaintiff commenced an action against the driver of the car and
the leasing company owner for negligence. The case settled before trial
for $400,000.00
$300,000.00 – Injured Construction Worker – Labor
Law – Torn Rotator Cuff
Plaintiff, a stone mason, was engaged in construction work
that required him to stand on a bucket to reach a height. When the bucket
collapsed, plaintiff fell to the ground injuring his left shoulder. Plaintiff
underwent a magnetic resonance imaging of the shoulder which revealed a
torn rotator cuff in his left shoulder. Plaintiff underwent arthroscopic
surgery to repair the damage. Plaintiff commenced an action pursuant to
Labor Law 240 against the property owner and general contractor. Plaintiff
was able to secure summary judgment on the issue of liability. This case
settled after opening statements for $300,000.00.
$200,000.00 – Injured Student – Motor Vehicle – Arthroscopic Surgery
Plaintiff, a student, was injured in a motor vehicle accident at the intersection of East 48th Street and Avenue N in Brooklyn, New York. Plaintiff claimed the defendant ran a steady red signal. The defendant claimed the plaintiff ran a steady red signal. The defendant had an eye witness to support his story. The defendant offered $25,000.00 to settle before trial. The offer was rejected and the case went to trial. HKPD obtained a jury verdict that finding the defendant 100% at fault for causing the accident. The case settled for $200,000.00 before the damages portion of the trial.
$200,000.00 – Injured Student – Motor Vehicle – Roll Over – Fractured Vertebrae
Plaintiff, a high school student, was a passenger in a motor vehicle on a school trip in Arizona. The driver of the van fell asleep causing the van to roll-over. Plaintiff sustained a hair-line fracture of one vertebrae that did not require surgery. The defendant refused to settle and the case went to trial. A Nassau County jury awarded a verdict for pain and suffering of $200,000.00.
