What Is Wrongful Death?
The laws of New York and New Jersey, and most other states, provide specific,
defined remedies when someone causes the wrongful death of another. These
laws are commonly called “Wrongful Death Statutes”. Damages
can include the victim’s pain and suffering prior to death, emotional
injuries to family members who may have witnessed the accident and compensatory
economic damages for those dependent upon the victim’s financial support.
What Are Wrongful Death Damages?
Usually, Wrongful Death damages include both economic damages
(projected gross income over the decedent’s lifetime, etc.) and
non-economic ones (e.g., pain and suffering prior to death as well as
lost enjoyment of life). Family members may receive funeral expenses
and medical costs. Sometimes, punitive damages are awarded.
Who Files a Wrongful Death Lawsuit?
When the victim has died before a lawsuit is filed, the law
permits the decedent’s heirs or a representative of a decedent’s
estate (typically a family member called an executors or administrator)
to file a lawsuit. In other cases, the victim passes away during
litigation, and the law permits an executor or administrator to proceed
with the lawsuit.
