Slip Trip & Fall
“Slip and Fall” & “Trip and Fall” – these are catch phrases for the law of “Premises Liability,” which refers to the legal remedies available to someone who slipped, tripped, or otherwise fell and was hurt because of a dangerous or hazardous condition on someone else's property. New York State law holds landlords, property owners, managers and renters responsible for personal injuries that result from an accident on their property.
Collectively labeled “Premises liability,” these claims include:
1. Slip-and-Fall accidents on wet floors, snow and ice covered sidewalks or other slippery surfaces;
2. Trip-and-Fall accidents caused by uneven, cracked or pot-holed sidewalks, crosswalks, roadways other unsafe surfaces;
3. Injuries arising from unsafe stairs, elevators, escalators, missing or defective hand-rails, steps, guide rails, or ramps;
4. Accidents involving falling merchandise
“Slip and Fall” & “Trip and Fall” injuries can happen on the sidewalk, the grocery store, the amusement park, the mall, at church, a hotel, the airport, a dormitory, restaurant, office building, sporting arena, supermarket, casino, motel, bus stop, hospital, or even in someone’s home. They can happen anywhere at anytime.
Under New York law, owners have the duty to maintain their premises in a “reasonably safe” condition for those entering their property as guests, visitors and/or customers. Property owners and landlords who fail to maintain the premises in a reasonably safe condition, are legally responsible for personal injuries that occur as a result.
Damages for premises liability accidents can include past and future medical expenses, pain and suffering and/or lost wages.
