Pedestrian Accidents

Almost all pedestrian fatalities involve a single motor vehicle hitting someone along or crossing a roadway. Fortunately, most pedestrian accidents are not fatal. Nevertheless,  at HKPD we understand that getting hit by a car can be a life-altering event. 

In 2005, there were 15,703 motor vehicle accidents involving a pedestrian in New York State alone. 350 of those accidents resulted in a fatality, and approximately 4000 resulted in moderate to severe personal injuries to the head, back, neck, shoulder, knee, nerve damage, brain damage, brain injury, spinal cord paralysis, physical disfigurement, the lost use of a limb or amputation.

While New York State has crosswalk laws designed to protect the pedestrian, these are of little comfort in the event of an accident.  Legally, drivers have the duty to yield right-of-way to pedestrians crossing the street, walking on a sidewalk or in front of driveway. Additionally, drivers of motor vehicles in New York must yield to any pedestrians crossing a street within a crosswalk, regardless of whether the pedestrian has a green light or “walk” signal.
