$3,000,000.00 - Confidential Settlement

$2,900,000.00 - Rigger - Construction Accident – Spinal Injuries

Plaintiff, a 40 year old rigger, while wearing a harness fell through a floor opening at a construction site. Plaintiff suffered herniated discs in his neck and back which required surgery. HKD filed suit against the owner of the building and the general contractor for failing to provide safety devices under New York's Labor Law Section 240(1). HKD partner, Jonathan Damashek was awarded summary judgment on liability. The case settled for $2,900,000.00.

$2,645,000.00 - Iron Worker - Construction Accident - Traumatic Brain Injury

Plaintiff, an 26 year old Iron Worker, fell approximately 4 stories after being struck by an unsecured piece of concrete. Plaintiff hit his head and was knocked unconscious. Plaintiff was diagnosed with Post-Concussion Syndrome also known as Traumatic Brain Injury, as well as with herniated discs in his lower back. Plaintiff suffered from memory loss, headaches and depression. He underwent years of cognitive therapy for the effects of his brain injury as well as spinal surgery to repair the herniated disc in his lower back. HKD was awarded judgment against the owner and general contractor on the issue of liability. The case was tried by HKD partner, Jordan Hecht, and settled after jury selection for $2,645,000.00.

$1,700,000.00 - Autobody Worker - Ceiling Collapse - Back and Knee Surgery

Plaintiff, a Bronx autobody repair worker, was injured when the roof of his garage collapsed. Plaintiff injured his lower back, neck and knee. Plaintiff was taken by ambulance to the emergency room and thereafter began treating for his injuries. Plaintiff ultimately had surgery on for herniated discs in his lower back as well as arthroscopic surgery for a torn meniscus in his left knee. The case settled for $1,700,000.00 on the day before jury selection was set to begin.
